The Stationary Source Audit Sample (SASS) starts on 6/16/2013

The information for obtaining SSAS audit samples is available on the EMC website www.epa.gov/ttn/emc/email.html#audit, therefore, the 60-day clock has started.  The EPA restructured program requires that two accredited providers be available, and available audit samples must be listed on the EMC website 60 days before audits are required. The two currently accredited providers are:

Interim Determination to Stay and Defer Sanctions for the Sacramento Metropolitan Air Quality Management District

EPA is proposing to fully approve two permitting rules submitted by California as a revision to the Sacramento Metropolitan Air Quality Management District (SMAQMD or District) portion of the California State Implementation Plan (SIP). These rules were adopted by the SMAQMD to regulate the construction and modification of stationary sources of air pollution within Sacramento County. EPA is proposing to approve this SIP revision based on the Agency’s conclusion that the rules are consistent with applicable Clean Air Act (CAA) requirements, policies and guidance. Final approval of these rules would make the rules federally enforceable and correct program deficiencies identified in a previous EPA rulemaking on July 20, 2011.  SMAQMD’s Proposed Rule Revions are to Rule 214 & 217.

EPA approves SJV SIP Revision for NOx on solid fuel fired boilers

EPA is approving revisions to the San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD) portion of the California State Implementation Plan (SIP). This action was proposed in the Federal Register on April 26, 2012 and concerns oxides of nitrogen (NOX) from solid fuel fired boilers (SJVAPCD Rule 4352).

There are some interesting comments on Earth Justice request to deny this rule revision, especially involving start up and shut downs of solid fueled boilers.

Evaluation of Private PM10 ERC’s for Determining PM2.5 Portion of ERC’s

The Sacramento Metropolitan Air Quality Management District (SMAQMD) is issuing a final public notice for the evaluation of currently-active and privately-held PM10 ERC’s in order to identify the PM2.5 portion of each certificate. The preliminary public notice was published in the Sacramento Bee on June 20, 2012. The identification of the amount of PM2.5 was based on CARB’s Speciation Profiles. The District will be reissuing the ERC certificates to identify the portion of PM10 that is PM2.5. The final evaluation of the PM2.5 may be reviewed at the SMAQMD office, 777 12th Street, Third Floor, Sacramento, CA 95814 or may be downloaded from the District’s website at: www.airquality.org. Public Hearings for the National Ambient Air Quality Standards for Particulate Matter

The EPA is announcing two public hearings for the proposed rule titled, ‘‘National Ambient Air Quality Standards for Particulate Matter,’’ that is scheduled to be published in the Federal Register on June 29, 2012. The hearings will be held in Philadelphia, Pennsylvania, and Sacramento, California.

In this rulemaking, the EPA is proposing to make revisions to the primary and secondary national ambient air quality standards (NAAQS) for particulate matter (PM) to provide requisite protection of public health and welfare, respectively, and to make corresponding revisions to the data handling conventions for PM and ambient air monitoring, reporting, and network design requirements. The EPA is proposing changes to the Air Quality Index (AQI) to be consistent with the proposed primary standards. In addition, the EPA is proposing revisions to the prevention of significant deterioration (PSD) permitting program with respect to the proposed NAAQS revisions.

EPA Proposes Updates and Deadline Extension for 2010 Cement Standards

WASHINGTON — In response to a federal court ruling and data from industry, the U.S. Environmental Protection Agency (EPA) is proposing changes to its 2010 air standards for the Portland cement manufacturing industry. The proposal would continue the significant emission reductions from the 2010 standards while providing industry additional compliance flexibilities, including more time to implement the proposed updates by extending the compliance date for existing cement kilns from September 2013 to September 2015.

In December 2011, the U.S. Court of Appeals for the D.C. Circuit determined that EPA’s standards were legally sound, but asked the agency to account for rules finalized after the cement standards were issued. The proposed updates to certain emissions limits, monitoring requirements and compliance timelines – which are expected to result in additional cost savings for industry – are being made in response to this court remand and petitions for reconsideration of EPA’s 2010 final rule, which will dramatically cut emissions of mercury, particle pollution (PM), and other air toxics from cement production.

Based on new technical information, EPA is proposing to adjust the way cement kilns continuously monitor for particle pollution and would set new particle pollution emissions limits and averaging times to account for these changes. The proposed rule would not apply to kilns that burn non-hazardous solid waste; those kilns would be covered by other standards. The proposed extended compliance date would allow industry to reassess their emission control strategies in light of the proposed changes to the PM limits and monitoring methods.

EPA will accept comment on the proposed changes for 30 days after the proposal is published in the Federal Register. The agency will hold a public hearing if requested to do so. EPA will finalize the rule by December 20, 2012.

Revisions to the California State Implementation Plan: Antelope Valley AQMD; Eastern Kern and Santa Barbara Co., APCDs

The EPA is taking direct final action to approve revisions to the Antelope Valley Air Quality Management District (AVAQMD), Eastern Kern Air Pollution Control District (EKAPCD), and Santa Barbara County Air Pollution Control District (SBCAPCD) portions of the California State Implementation Plan (SIP). Under authority of the Clean Air Act as amended in 1990 (CAA or the Act), the EPA is approving local rules that define terms used in other air pollution regulation in these areas and approving a rule rescission that addresses Petroleum Coke Calcining Operations—Oxides of Sulfur.

DATES: This rule is effective on July 3, 2012 without further notice, unless EPA receives adverse comments by June 4, 2012. If the EPA receives such comments, we will publish a timely withdrawal in the Federal Register to notify the public that this direct final rule will not take effect.

Revisions to the California State Implementation Plan: San Joaquin Valley Unified Air Pollution Control District

The EPA is proposing to approve revisions to the San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD) portion of the California State Implementation Plan (SIP). These revisions concern volatile organic compound (VOC) emissions from wine storage. The EPA is approving a local rule that regulates these emission sources under the Clean Air Act as amended in 1990 (CAA or the Act). The EPA is taking comments on this proposal and plan to follow with a final action.

DATES: Any comments must arrive by May 30, 2012.

EPA is making an interim final determination to stay the imposition of offset sanctions and to defer the imposition of highway sanctions based on a proposed approval of revisions to the San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD) portion of the California State Implementation Plan (SIP) published elsewhere in this Federal Register. The revisions concern SJVUAPCD Rule 4352, Solid Fuel Fired Boilers, Steam Generators and Process Heaters.

DATES: This interim final determination is effective on April 26, 2012. However, comments will be accepted until May 29, 2012.
