EPA Proposes to Require Oregon, Idaho, Alaska (and other states) to Update Clean Air Act Permitting Programs to Address Greenhouse Gas Emissions

One of the EPA actions released this month is a proposed determination that the Clean Air Act implementation plans (State Implementation Plan or SIPs) in thirteen states are “substantially inadequate” because their PSD programs do not apply to new or modified greenhouse gas-emitting sources. EPA would require that non-compliant states issue revised SIPs within 12 months of issuance of the final rule . In another action/rule, EPA proposes assuming responsibility for PSD permitting for greenhouse gas emissions for those states that do not timely submit compliant SIPs, via a Federal Implementation Plan (FIP).

National Emission Standards for Hazardous Air Pollutant Emissions:

  1. Hard and Decorative Chromium Electroplating and Chromium Anodizing Tanks
  2. Group I Polymers and Resins
  3. Marine Tank Vessel Loading Operations
  4. Pharmaceuticals Production
  5. The Printing and Publishing Industry
  6. Steel Pickling–HCl Process Facilities and Hydrochloric Acid Regeneration Plants

SUMMARY: This action proposes how EPA will address the residual risk and technology reviews conducted for two national emission standards for hazardous air pollutants (NESHAP), and this action is a supplemental notice of proposed rulemaking for an October 2008 action that proposed how EPA would address the residual risk and technology reviews for four NESHAP. The six NESHAP include 16 source categories, 12 of which are the subject of residual risk and technology reviews in this package. This action proposes to modify the existing emissions standards for eight source categories in three of the six NESHAP to address certain emission sources not currently regulated under these standards. It also proposes for all six NESHAP to address provisions related to emissions during periods of startup, shutdown, and malfunction. Finally, this action proposes changes to two of the six NESHAP to correct editorial errors, make clarifications, or address issues with implementation or determining compliance.

Sewage Sludge Incineration Units – New Standards Proposed by EPA

On September 30, 2010, the Environmental Protection Agency (EPA) proposed new source performance standards (NSPS) and emission guidelines (EG) for new and existing sewage sludge incineration (SSI) units. The proposal would reduce emissions of air toxics and several of the common pollutants called criteria pollutants.
